Sex offender faces child pornography charges

— A registered sex offender living in Whitewater has been charged with first-degree sexual assault of a child and possession of child pornography after a search of his residence.

David L. Wells, 46, of 218 S. Cottage St., Whitewater, was arrested July 23 on suspicion he grabbed the buttocks of an 8-year-old girl at Wal-Mart, 1362 W. Main St., according to the criminal complaint.

Officers recognized Wells from the description given by store security and arrested him at his home, Whitewater Police Chief James Coan said.

Subsequent searches of Wells’ home resulted in additional charges, including seven counts of possession of child pornography and one count of a registered sex offender intentionally photographing a minor without consent.

Investigators found seven explicit photos of children in the house, according to the criminal complaint.

A compact disc with digital photos of young children who appeared to be at the Whitewater Fourth of July parade, a beach or a zoo also was found, according to the criminal complaint.

What a record David L. Wells has, and what a sorry statement for the criminal justice system.
On 6-1-’87 to 8-2-’87 he committed 4 sex crimes for which he plead no contest to 4 misdemeanors and got 3 years probation starting 3-18-’88 for all 4 counts (3 counts Indecent Exposures and 1 count of Sexual Assault-4-) in a single court action in Walworth County (a plea bargain?).
On 5-8-’90, while still on probation, he committed a sex crime for which he plead no contest to the charge of “Lewd, Lascivious Behavior” ,a misdemeanor, and was sentenced to 90 days in jail in Dane County.
On 5-6-’95 he again committed a sex crime for which he plead no contest (4th Degree Sexual Assault) and a disorderly conduct charge and received yet another sentence of 2 years probation in Dane County starting on 9-5-95.
On 8-31-’97, while still on probation again, he committed 4 misdemeanor sex crimes (4 counts Exposing Genitals to Child) to which he plead no contest and one felony charge was dropped at the prosecutor’s request (a plea bargain?) and was sentenced to 9 months in jail on all charges with 2 jail terms stayed and a pair of 2 year probation terms imposed in Jefferson County.
On 8-8-’99, while on probation once more, he plead no contest to a charge of disorderly conduct with a charge of Possession of Child Pornography dismissed on prosecutor's motion and received 18 month’s probation in Walworth County.
So now the Walworth County D.A. has filed 9 felony charges against Mr. Wells. Will they finally get tough with him or are a plea bargain and more probation in Wells’ future?
