JANESVILLE An attorney hired by the city has concluded that city employee Mike Williams illegally destroyed at least one public record and probably a second.
The results of the investigation were released to the media Monday.
It also exonerates former City Manager Steve Sheiffer as being the person who directed Mike Williams to destroy the record.
Attorney Steven Zach said it is his opinion after his investigation that Williams destroyed the record at the request of his employee Steve Fisher, assistant ice rink supervisor.
"While the information did not have to go into the employee's personnel file, it had to be retained," Zach said. "In not doing so, Williams erred."
Meanwhile, Williams has announced his retirement, and his last day is Jan. 9.
Jay Winzenz, acting city manager, said the city did not force Williams to retire. He said the reason for Williams' retirement would have to come from Williams.
The Janesville Gazette has not been able to reach Williams for comment.
Williams was investigated for destroying city records relating to a personnel case involving Fisher and a relative of Sheiffer's employed part time at the ice arena.
Bonnie Davis, recreation director, taped her conversations with Williams in May. Davis said she made the recordings to protect herself and her employee.
On the tape, Williams is heard saying he destroyed computer records relating to the case, and that he promised "Steve" he would do so. Williams later said the "Steve" was Steve Fisher. Davis and Fisher both suggested that Steve Sheiffer asked Williams to destroy records.
A second investigation into Davis has not been released pending notification of the employees listed in the second report. Davis is accused of wrongly releasing employee records.
Davis had been out of work on family leave, Winzenz said, but returned last week. She currently reports to Jennifer Petruzzello, neighborhood services director, rather than Williams.
Zach said Williams violated state statutes and city ordinances but did so to keep the materials from Fisher's file.
Zach said it is his opinion that the "Steve" referred to on the tape is Fisher, not Sheiffer.
He said Williams's story has been consistent, and that Williams had no reason to continue lying after Sheiffer retired in September.
Susan Musick, personnel director, retained records in her file, as well.
"If Sheiffer wanted all documentation regarding the event destroyed, he would have directed Musick to destroy her documents," Zach said.
Zach said Sheiffer and Musick deny that Williams was directed to destroy records.
Sheiffer also would not have written two additional memos to Williams and other city employees after the January complaint, Zach said.
Zach said he could find no motive for Sheiffer to order such an action.
"To the extent others would attribute his motives to any issues of nepotism, that first became an issue much later than the January investigation and alleged order to destroy the records," Zach said.
Rather, Zach does believe a motive exists for Davis's and Fisher's accusations.
"It is my conclusion that Davis and Fisher have a negative attitude toward city administration and, therefore, a motive to claim that Sheiffer ordered the destruction of the documents. They conferred with respect to this matter on several occasions," he wrote.
The city ordinances do not include a penalty, so the penalty reverts to those included in state statutes—a fine of not less than $25 nor more than $2,000. The city or the district attorney would have to file charges against Williams.
Winzenz said the city has not made a decision on whether to prosecute. The matter remains under investigation because Williams still has rights as an employee.

gazettegazer, you're sincere in your examination of this. But it's easy to say let the lies see the light of day when it's someone else who's being lied about. Recall the damage that McCarthyism did to reputations. A lie can be announced as a lie and still ruin someone's reputation. Fisher wasn't a public figure.

There was nothing concrete in all of this background to suggest the girl lied. There was innuendo of poor work ethic by Davis et. al.

Since that time we've had a third party attorney establish that Davis and Fisher had motive and animus. We've had said attorney establish that Fisher wanted this alleged lie covered up instead of examined in the light of day.

There are no real facts but surely you must see that the burden of suspicion shifts to the folks who have participated in the lie and cover-up

gazettegazer, my speculation is supported by the details given in the story.
My impression is that Fisher attempted to discipline the girl. That she was a discipline problem has been established. In the course of the investigation the girl lied about Fisher.
Don't just make wild speculations; attached your ideas to concrete facts.

With all the information to date, it becomes extremely difficult to place blame on the girl for lying, when the others involved in the issue have done the deceitful things.

gazettegazer, I'm not condoning any of it. I was just trying to make some sense out this story and the original one.
I think the problem with this matter is: Williams or someone tried to sort the whole thing out. The girl lied about Fisher. In the process someone had to record her lies. With Fisher's encouragement Williams came to the conclusion that it was fair to destroy the recorded lies of the girl. That's what I think happened. I haven't seen anything in this that makes Sheiffer culpable.

Wouldn't you agree that the best way to combat lies is by truth....shining the light of day on them? Seems to me that wanting allegations (particularly false ones) destroyed is not the way to go about this.

I think this issue sprang from the girl needing to be disciplined. In the subsequent attempt by superiors to deal with the problem, the girl possibly lied about Fisher. The lies were recorded on documentation not as the truth but only as a matter of recording the girl's "side" of the problem. Fisher preferred that the documents be destroyed. (No one wants lies about themselves made a matter of permanent record.)
Because the girl is related to Sheiffer and because Fisher had some animus toward Sheiffer (according to Zach), Fisher attempted to besmirch Sheiffer by claiming he, Shieffer, was involved in a cover up or some such thing. Zach determined that Sheiffer wasn't involved.

You mean the alleged lies told by a young girl (that had no motive) about Fisher(who does have a motive and animus against Sheiffer), who is implicated with Davis (his supervisor that has an motive and animus against Sheiffer), who convinced Williams to destroy said record. Are those the lies that nobody is asking about? Man they must be doozies

So, we have an outside impartial lawyer that exonerates Sheiffer of the whole deal that appears to support this conclusion with actual facts. And it indicates it wasn't a "nepotism" related issue. That seems to be the real story here.
The second question seems to now be, what did Fisher do that he didn't want in his file?

Let's take a poll, all in favor of Mike Williams staying, write in and say so. All in favor of Ms Davis leaving write in also. How effective can she be without the trust of the people that report to her? From what I saw, the whole department was running a whole lot better while she was gone on her leave. I know Mike will not stay but without him, the city is on the losing end. By the way 1 vote for Mike Willams staying from me.

The conclusion explains it all. Davis should be dismissed for false accusations, and inappropriate conduct of a Director. If anything, taking personal matters to Allison and the public. What a dandy.

As important as it is, the destruction of the records in this matter is unimportant compared to all the accusations about Sheiffer.
If the "record destruction" issue made it to the surface, why not the really important stuff about Sheiffer. The Gazette developed the "record destruction" story, why not the Sheiffer stuff? Maybe because there's nothing.

Drama always seems to follow Davis where ever she goes. This whole thing was mismanaged. It would be like trying to explain who is at fault with the Green Bay/Brett Favre split. It takes two to tangle, but only one to "win". Mike is demanding and requires accountability of his staff. As a taxpayer, I expect Mike to do that. If Bonnie thought that the City of Janesville was such a bad place to work for, why didn't she leave? So many unanswered questions. Time to move on, and wish Mike health and happiness in his retirement, and let him know his career was distinguished, regardless of this 'stain'.

I cannot figure out exactly what Davis was protecting herself and her employee from. Is there something missing here? Also, why go public instead of bringing the situation up to the new city management or the city council. The term self serving comes to mind. I also question the statement that the city did not request Mike Williams to retire... if that is true, please change you mind Mike. The city needs more managers like you and less like Ms. Davis, Any employee that doesn't worry about the recorder running when talking to her is making a mistake...how I wish all of Ms Davis's conversations had been recorded...very interesting concept. Any former employees have any thoughts on that one???

Ernie, you're still sounding like B'moon. From the stories on this matter it's easy to conclude that Fisher didn't order Williams to do anything. He made his wishes know re: the records and Williams, wrongly looking out for an underling, destroyed them.
Also Williams said it had nothing to do with Sheiffer.

RichE95, Yes, You are so right! And for those of you attacking me and think I am like Bmoon, NOT! Never! I just know what goes on in city government. The attorney was hired by the acting city manager who worked under the old city manager and is a member of the "good ole boys club". So the attorney hired was paid to make a "favorable" accounting on the city's behalf. Make Davis and Fisher a scapegoat for the city managers illegal actions. And, A subordinate(Fisher)DOES NOT tell a department head(williams)to destroy records!

Many years ago I had an event with Mr Williams when he was in charge of sidewalk insprections and oversaw the contractors removing elm trees. Hopefully the Gazette won't delete this comment but I am not surprised by recent disclosures of his actions. Don't attack the underlings when they report problems with their surperiors in city government.

Ernie...I don't disagree with everything you're saying, but I think Davis and Fisher set up Mike Williams. Fisher didn't want a record of this incident in his file and Davis recorded her conversation with Williams, knowing he would get into trouble for destroying documents - no matter whose request it was. If anything - the media is slanted AGAINST City of Janesville management and with good reason - most of the time, but not always.

Its all a cover up for those that were, and are now in high places to protect themselves. I agree. Bonnie is obviously paranoid due to her job performance. Just remember this; liars think everybody lies to them. Thieves think that everybody is stealing from them. Cheaters think that everybody is cheating them. Get the point Bonnie? What a sad way to end a great career for Mike. He did excellant for the tools and budget given to him. He reminds me of the life of a NFL linemen. If their name is never called, they are doing a great job, only when something is screwed up they get their name called. Mike should be honored for his service (which includes military)to the public.

Having worked for Bonnie Davis I trust her as far as I can throw her. A number of people have been left jobless due to her actions. It appears that Mike Williams is another of her victims.
