Lake Geneva alderman's citation dismissed

— A letter of apology was enough Wednesday to dismiss the disorderly conduct citation against a Lake Geneva alderman accused of yelling at the Lake Geneva city clerk, Walworth County District Attorney Phil Koss said.

Alderman Tom Spellman was cited Oct. 9 following allegations he yelled at City Clerk Diana Dykstra on July 25.

Spellman was accused of getting "very angry" with Dykstra for not putting an item on a meeting agenda as he had requested, according to police reports.

Dykstra told police Spellman sent her an e-mail Aug. 3 to apologize for raising his voice. But he also wrote that she needed to "go back to the (municipal code) and read what (her) duties are relative to the agenda for (city) council meetings," according to police reports.

Spellman told police he did not scream at Dykstra. He said he was frustrated about the agenda, and when he gets that way, his voice raises, according to police reports.

Dykstra said she received the letter of apology Wednesday.

"I'm sorry I raised my voice when talking to you July 25 about the agenda item," the letter reads.

Spellman said in addition to sending the letter to Dykstra, he plans to write a letter to the editor of the Lake Geneva Regional News in reference to the incident and other city issues.

He said he also plans to seek reimbursement from the city for his attorney's fees.

"The city will pay, there's no doubt about that," Spellman said. "When I get the bill from (my attorney) it will be forwarded to the city."

Dykstra said she is pleased the situation has been resolved.

"I am very happy to see this ordeal is over," she said. "An apology was all I ever wanted.

"As employees of the city, we are all trying to do our best, but misunderstandings sometimes happen. I just hope in the future they can be discussed in a professional manner."

GOOD EXAMPLE OF GOVERNMENT A__ __ KISSING . I WOULD LIKE TO SEE WHAT I WOULD BE TOLD IF I SENT LETTER OF APOLIGY FOR MY CITATION . THE NEW MAFIA OR CROOKES IS OUR GOVERNMENT.

I don't deny that she needs a MUCH thicker skin. I'm not arguing that point. However, I would put enough trust in the PD to ASSUME they wouldn't have charged this if there weren't some "real" circumstances here. If she's that thin-skinned, then she needs to go too.....But in the end, they shouldn't be paying any fees. He's the idiot that hired an attorney to contest a Municipal DC charge. If you "lawyer up" that quickly. Pay the damn bill, NOT the city.

This is not about whether or not Dykstra has thick skin or the fact that Spellman is old and old people tend to talk loud....what a JOKE! Spellman is a prime example of a local Politian that thinks he is somebody special! He feels everyone needs to jump at everything he says and although he "apologized" he obviously did so to avoid being charged with DC, not because he means is. Now he’s saying the city will pay his attorney fees. GIVE ME A BREAK! WHO DO YOU THINK YOU ARE SPELLMAN! Lake Geneva would be smart to get rid of this idiot as soon as possible!

If Lake Geneva ever needs additional revenue they could ask one of the Networks to create a new reality program that follows their little city administration dealings as they "wrestle" with tough issues each week. Jerry Springer could serve as the host since he has experience in dealing with individuals possessing the same mental capacity. Then instead of their city administration just being the "joke" of Wisconsin, they could share their stupidity with the rest of America.

This was a mountain made out of a molehill by Dykstra. She could of ended the call at anytime.
People who regularly deal with the elderly (Spellman) know they often raise their voices when excited (either good excited or bad excited) because of hearing loss.
Does Dykstra report people who yell about a parking ticket to the police department too?? NO I see far more of those incidents at city hall (and they are in your face, screaming episodes). Get over yourself Dykstra-you just wanted to see if you could get him off your back (for not doing your job repeatedly) by telling on him ...
As for only wanting an apology, Spellman gave you one before this but you needed a "public one".....
The city should pay his legal fees since he was doing his job (requesting items be put on the agenda), and another city employee was involved. This could of been all handled internally, but no Queen Dykstra had to have a hissy fit.

Why would you even need an attorney to represent you on a disorderly conduct charge stemming from an incident in which your crime was raising your voice. That sounds like overkill to me but I'm not a Lake Geneva taxpayer.

The article doesn't say the city will pay the attorney fees, the alderman does. I can't believe he would expect that, nor would I expect the city to accept that they will pay.

I don't know what the policy is in their city, but many times the only individual who can add something to an agenda is the chair/mayor, unless it is done at a counsel meeting in a very specific way. Spellman should have contacted the mayor to get his item on the agenda.

Oh Pleeeeeaz! get over it! You mean to tell me that she has never raised her voice to anyone when faced with frustration??!! Deal with it and do your job next time! Of course I think it's absurd that the city will reimburse the attorney fee! Grow up and get real!

Are you kidding me??!! The City will reimburse his attorney fees? Nice precedent to set, Lake Geneva. Will you, in the future, be paying any attorney fees for other defendants who end up having their citation dismissed, for one reason, or another? Will your city attorney now dismiss all citations, when a proper apology is extended? THIS is the type of BS that gives small town governments a black eye. And talk about arrogance, "The City will pay (the attorney fees), there's no doubt about that", says the defendant. Wow, this is absurd.
