Teen to appear in court in drunken-driving death

— A Genoa City teen accused of killing a man in a November drunken-driving crash and then drinking alcohol while free on bail will be back in Walworth County Court next month.

Krystal A. Hart, 17, appeared in court Friday on the felony charge of homicide by intoxicated use of a vehicle in the Nov. 3 head-on crash that killed Everado Chimal Lopez, 54, Delavan.

She also appeared on a misdemeanor charge of obstructing an officer and a felony charge of bail jumping stemming from a March 15 party in Lake Geneva, where she was suspected of drinking alcohol while out on bail and lying to officers about her name.

Hart’s attorney, Jim Martin, told the judge the Geneva Township Police Department has not released for independent testing the blood sample taken on the night of the crash.

Judge James Carlson decided to hold a court hearing Aug. 27 to review the status of the case.

Hart has pleaded not guilty. She remains free on a signature bond co-signed by her parents.

level more than twice the legal limit and marijuana in his system, authorities
said.
THIS IS WHAT WI NEEDS TO DO!!! The laws here suck for drunk drivers!!!!!!!

She needs to go to jail. She needs to own up to what she did! I don't care if her entire family are alcoholics, it is no excuse for killing someone. Everyone has issues and family problems, but that gives no one the right or excuse to act like an idiot and end up killing someone. Clearly she showed more poor judgement in choosing to drink alcohol again and then lie to police about it. If she were my kid I would not be spending all my money on a lawyer. I'd rather see my child face the music and get what they deserve. It is pretty clear what happend, and there is no excuse.

I'm with you. Rather than people get so wrapped up in judging this person, we should all take a good look at ourselves and work on US! We've got plenty of people out there who get so wrapped up in what's happening in other people's lives that we forget to look in the mirror at ourselves. We can all stand to improve ourselves whether we want to believe it or not. Too many people enjoy reading about subjects like this because it actually makes the feel good about their own lives. Almost like a false sense of well being. "I guess my life isn't so bad afterall"... which isn't all bad, but, we can't just settle for that. We should be working on making ourselves better everyday. Use tragic events like this as an example for our children so they don't make the same mistakes. The adults are no different, they can learn as well. Some never do.

Can't we just remember not to judge? I know it is easy to, but can't we trust in God to do His work? I'm sick of society playing the judge.

There have been some good and valid comments in this blog regarding what should happen to Krystal Hart, should she be convicted of the crime(s) that she is accused of, and I am thankful that we are allowed this forum in which we can express our opinions.
Based on some of the news I have read and watched on the TV news, I think there is a horrible “parental” problem that has, and continues to contribute to Ms. Hart’s behavior, but that is up to the court to decide. Whether she gets jail time, help or whatever, I wonder what type of help, if any, the family of Mr. Everado Chimal Lopez has received.
Whatever happens to Krystal Hart, the family of Everado Chimal Lopez will never see him again. My personal condolences go out to his family. Just my opinion.

I remember seeing her on tv after the accident at an arraignment hearing. She had either a broken arm or a leg, I don't remember which, but I do remember the cast. It was bright pink. She kills a man and she's in the hospital picking out the color of the cast she wants. That told me everything I needed to know about her.

I am not so sure I would be singing the same tune if it were my own loved one, I will be honest about that. But, I do have to say I pray that I have the faith to believe that when our time is up it is up....and there is nothing that could have been changed. That is something a person has to come to believe, or the wondering and what if's will and do drive you crazy and stop you from grieving properly. And you must grieve properly to go on with life. These are my opinions only, and I am not trying to force them down anyone's throat, but I do believe that when one's loved ones pass on, we need to find a way to except it, one way or another, or not only one life has been taken but two.

"Ihavealife" I'm sorry to hear about your brother. Really, that is terrible. But it sounds like the person who killed him DIDN'T get the help like "optimism" is suggesting for this girl. Maybe had he gotten rehabilitation and counseling in prison then he would have re-entered the world a better person. Maybe his family wouldn't be such a wreck and he would have learned from his awful choices.

I agree with "optimism" that this girl sounds like she has some real, deep down issues to work through. I think prison time is a given, but come on people, you lock a young very troubled girl up in a cell for 20 years and she's going to come out even more screwed up. Why would we WANT that for our citizens? I, too, hope that the state takes the time and money to really rehabilitate her while she faces her sentence.

As far as the family who lost their loved one...I am so sorry for your lost. Even though it was in such a tragic way, let's all have faith that when our number is up, our number is up. And one person's demise is sometime another's lesson.

I disagree with her having to do jail time. In my opinion if a 17 year old girl is drinking and driving and kills someone, and then neglects to see her actions as serious as they were and continues to drink, she clearly has some deep down problems to deal with. The mere fact that she killed someone is going to be a lifetime sentence. Throwing her in a cell at such a young age just won't help matters. I believe that if she is sent to prision, she will only be worse when she re-enters society. Help this kid, research her family back ground and get her some help. Whenever kids continually turn to alcohol, even when consequences were had for doing so in the first place, there is obviously a problem deeper then the drink going down the throat.
