Man gets one year probation for rape
ELKHORN A Lake Geneva man convicted of violently raping a woman in his home in October was sentenced Monday to one year’s probation.
The 33-year-old woman told a police James K. Ross, 52, 309 Cook St., slammed her head into a closet door and whipped her head with a belt before raping her, according to a criminal complaint. The woman said she tried to leave four times when she thought Ross was asleep, but he would wake up, grab her hair and pull her back, according to the complaint.
Ross received no jail time for the felony charges of second-degree sexual assault and false imprisonment and a misdemeanor charge of battery. He is not allowed contact with the woman, her mother or their residence. He is required to attend counseling and pay $49,150 in restitution to the victim.

wow what is wrong with this picture you can rape or molest a child in walworth county under judge carlson and D.A joshua grube and get off but dont get caught with weed cause your doing time this sickens me i know people who are facing 3yrs in same court room for weed charges and they hurt knowone what is going on there? yea there out to protect the people we need to vote these people out !% of americans are in jail and 50% of them are non violent because of exactly this kind of justice while our state is spending our money to house people in jail that hurt knowone an investigation needs to be done in walworth county. it sickens me to be an american right now.way to protect the people grube and carlson maybe next time he will kill. but as long as those pot heads are off the street your doing your job huh. who cares about the rapist and child molesters right! youll make sure they got nice hotel rooms at the nickel plate how can you people sleep at night

Probation? What an insult to the victim...or should I say survivoir. Probabtion is about as effective as a restraining order. Someone who is this violent will follow a rule on a piece of paper on his own. He needs to be locked up, and monitored where he is no threat to civilians. He will violate his probation and end up in jail...and to him it is a chance to have one last hooray. Sad that it is going to be at the expense of another innocent woman.

even if you remove the rape from the equation, he still smashed her head into a wall (violence), beat her head with a belt buckle (violence), and pulled her hair (violence).
I concur with booner: "Violent offenders get often get probation."
Personally, I think the Rock County DA office is getting a little better about sentences, but for this guy to get off with Probation in Walworth County is strange. Perhaps they know he will not be able to stay out of trouble for the entire probation period and they will have more ammunition to lock him up ... not necessarily logical or realistic, but just a thought.

Remember the case of rape last month. He has not been found guilty and he sits in jail and here is a guilty man roaming free. Shows you how screwed up our courts and gov't is. You know last months so called rapist, his lawyer is loving this!!! How can they (the courts) allow two different outcomes in a rape case. Maybe the guy who is on probation has a little extra cash to offer the system. Like my name... WAKE UP AMERICA!!! And here we are in an election year. To think that one of those 3 idiots will run our country. God help us all!!!!!!!!!

Wake up people....this happens all the time. DA's make bad deals and the Judges rubber stamp them. Violent offenders get often get probation. Do some research. It happens every day. People seem to care more about city council elections than judicial or District Attorney elections. Look at Rock County....the DA and Judges run unopposed all the time. Judicial elections impact your quality of life more than anything else.

I went to the courthouse and obtained a copy of the criminal complaint through an open record request. This case is not what it seems. Buzz words like rapist and such are what sells newspapers!

This judge should be ashamed of himself. I hope the people in Walworth county don't let this judge back in the courtroom himself. What a shame for the young lady. She has to look behind her back wondering if this guy is stalking her or not.

I agree with garyprimer on this one, WHERE'S THE PICTURE? The Gazette will post pictures of the accused kids of the liquor store robbery, and some photos of dancers, all of which are still presumed innocent, until their day in court. I much would rather know what the CONVICTED RAPIST in my town looks like. Shame on the Gazette.

First of all, many of you need to really look at the big picture. Sexual Assault cases usually don't go to trial and most victims don't want to testify, and re-live those horrific events. The plea bargins that are put in place allow the victim to ask for whatever sentance they would like. The plea bargins usally allow the DA to argue freely for the sentance. There is always a pre-sentance investigation done by the Department of Corrections in any felony case. Those reports are used to guide the judge, along with what the victim wants. I am sure there is much more to the story than what the Janesville Gazette put in.

I am sickened to my core! Unbelievable how failing our judicial system can be. Nice to think that someone could do this to me and just walk away with it, just a petty slap on the hand?!? For crying out loud! he didn't try taking a cookie?!?! He brutally assaulted a woman, violated her physically and emotionally, held her hostage, and I guess it's ok to do that to someone nowadays?!?!? No, he should be locked up. Just because that woman says that is what happened doesn't mean the DA could prove the case. Perhaps what she said happened wasn't supported by the medical evidence. Perhaps other witnesses came forward that contradicted the woman. The only thing written in the criminal complaint is what the DA wants to include, and it usually doesn't include anything that undermines the case.

who cares what kind of case the da had. evidently he had something or he would have never been charged. this and outrage! this judge needs to be evaluated and so does his other cases. this judge needs to be removed from the bench, while and investigation takes place. i cant believe this ok with people. the hell with the restitution! this woman deserves justice. their are people sitting in our prison system on probation violations. and this man walks, unreal! once again the good ole boy rule applies.

AGAIN justice is served to protect the community what a joke but the system we have is not much as to the protection of victims. I hope they dont give any more cases to this judge. I feel so sorry for the victim as she is worth restitution that she will most likely never see as 1 year probation is not a very long time to earn it but she isnt worth justice for the violence she suffered.

I am sure Mr. Ross will pay the restitution right after he is finished paying the trafic fine from 2002. It's on his 'to do' list; stop nagging already! In all reality, this is an outrage. It's unfair to the victim, does not keep us safe, and does nothing to deter others from engaging in senseless crimes like this.

I'll be watching to see what punishment those "Service technicians" at Screamin’ MeeMees get for willingly selling their service to those eager and willing to purchase said service, compared to this man who found it his right to forcefully beat someone unwilling to give away the same service, and stealing it from her. Not that I think either case should go unpunished, but..hmmm, one is "victimless" and the almost unounished one is a violent crime.

May as well save some space in a future edition of the Gazette for the story "Convicted Sex Offender Arrested Again". I'm sure that whole year on probation (which means next to nothing to a guy who has no respect for the law or for other human beings) and a large amount of restitution (which this guy will never pay because I doubt he's trading stocks on Wall Street) are a great comfort to the victim and will help greatly in her attaining some closure. Good job Wisconsin judicial system, keep up the good work...
