Man accused of beating his father charged with battery

— A 26-year-old Lake Geneva man accused of beating his father, who later died, has been charged with felony battery and disorderly conduct.

District Attorney Phil Koss earlier told The Janesville Gazette that his office was considering a reckless homicide charge against Jacob D. Newer, 26, of N2020 County H, Lake Geneva.

The Gazette was not able to reach Koss for comment Tuesday.

David J. Newer died Feb. 28 from injuries authorities believe were inflicted by his son, Jacob, during a fight the two had at the Inn-B-Tween Motel, N1691 County H, between Pell Lake and Lake Geneva.

David was beaten sometime during the early morning of Feb. 26. Jacob and his uncle Frank Newer, David’s brother, took David to Aurora Lakeland Medical Center about 14 hours after a scuffle between Jacob and David.

David sustained life-threatening injuries from bleeding on the brain and was unconscious.

According to the criminal complaint, an emergency room nurse heard Jacob say, “I’m sorry, Dad. I’m sorry, Dad. Please get better.”

David was flown to St. Luke’s Medical Center in Milwaukee, where he died two days later.

David and Jacob were visiting Frank at the motel, where Frank lived, according to police. Frank said he heard his brother and nephew fighting. David was intoxicated, according to the criminal complaint.

Newer will appear in court Thursday.

could i ask why this man wouldnt be charged with attempted murder or murder? he died didnt he? that was cause by his son that beat him wasnt it.. so that just says MURDER!!!

There is too much violence shown in the media and on cable. Video games have become severely violent. The games give rewards for being violent.

I have always believed all judicial systems are corrupt. While a murderer or rapist gets probation and very little time in jail, a person caught stealing food for their family or a person that has been caught for driving without a valid license, may serve five years in a state prison.

Battery should only be charged by the DA with the permission of the LIVING victim. People need to be held accountable for their actions. Every action a person takes should be thought out, not be fueled by emotions.

This happened a little more than a mile away from me, and I only heard about it from a Janesville citizen.

Okay...What's wrong with the Walworth County Judicial System? Yesterday, a man convicted of RAPE was sentenced to one year probation, and restitution, only. Now the DA charges a man with ONLY battery and DC, after the man beat his father to death? That is completely illogical when compared to the sometimes excessively harsh charges and sentences that are handed down on seemingly less violent/serious crimes.
