Teen pleads guilty to OWI homicide

— The Genoa City teen accused of killing a man in a November 2007 drunken-driving crash pleaded guilty Wednesday to homicide by drunken driving.

Krystal A. Hart, 17, also pleaded guilty to charges of felony bail jumping and obstructing an officer. An additional charge of felony bail jumping was dismissed because the violation happened while Hart was mistakenly charged as an adult in the drunken-driving homicide, District Attorney Phil Koss said.

In March, while Hart still was mistakenly charged as an adult and out on bond, she was caught drinking at an underage alcohol party. She also gave officers a fake name.

In April, the homicide charge in adult court was dismissed and a juvenile petition was filed against her. Later that month, she was waived back into adult court on the homicide charge.

At the time, Koss explained that juvenile drivers who commit a traffic offense, such as speeding, are treated as adults. But homicide by drunken driving is a criminal offense, and so Hart initially should have been referred to juvenile authorities rather than arrested as an adult.

Hart pleaded guilty Wednesday to a second felony bail jumping charge stemming from a September incident in which a Walworth County sheriff’s deputy noticed she smelled of alcohol. As a condition of her bond, she had been ordered not to drink alcohol.

The judge Wednesday revoked Hart’s bond, and she remained locked in the Walworth County Jail this morning.

Hart will face a maximum of 31 years and nine months in prison when she is sentenced Jan. 30.

Seven years is a long time. She will still be young and hopefully will be able to rehabilitate herself and maybe help others... only time will tell...
And yes, I know that the person she killed will not get that time, but some good, even a little, can still come out of this tragedy.

She should be doing a heck of a lot more than 7 years.
So she will get out and no doubt get drunk again. She didn't learn her lesson this time. What makes anyone think she will learn anything while in prison?

ok people..yall need to stop bein so mean..you think krystal is bad..your tha bad ones sayin tha stuff you do..specially when u dont know her..she is young and is sorry for what she did..yeah she messed up killed someone and messed up after that..then maybe you should blame who made alcohol legal..no one is perfect..u people sure aint..and for tha guy she killed he was doin somethin illegal too he is an immigrant..yeah its sad tha accident killed him..but think bout how she feels ok..not only is his life over but soo is hers and it has not even begun..try bein her and havin that on your shoulders that you were bein a teenager and partyin and knowin you killed someone over it..

We All Make Mistakes. Too bad for her that she didn't learn from the horrible mistake of Homicide by DUI. Possibly, if she had not gone back to drinking again her sentence would have been lighter and even perhaps tried in Juvenille court. Either this girl is in denial about her drinking or the accident that she caused effected her to the point of no return.
I don't condone what she did, but due to her age, I hope she gets help and learns from this.

funny thing, karma is. Until someone drives under the influence and kills or seriously hurts one of those she claims she loves - she won't care. All she cares about is that she's free. She can plan for the next party. She can kiss her boyfriend, etc. Too bad her victim's family has to keep struggling financially, grieve their loss, and can never kiss him again. Selfish little girl. A rough upbringing is an EXCUSE, not a REASON.

Ahh, it does appear she is not remorseful. It's a shame... hopefully one day she will be able to fully understand the seriousness of what she has done. Hopefully some day she will be remorseful.

There is not one word about that man or his family on her page. Not even anything mentioned in her comments around the time of the accident. All her pictures on there are happy picture of her with her friends. It makes me sick. I wonder if there is a page for him somewhere. I'm gonna look!

She should have to make a MySpace page dedicated to the man she killed. Then Post pictures of him and all his loved ones. And say, "this is the man I killed". I hope his family can forgive me someday.......

Where are her parents? If I remember correctly, the first time she was caught at a party her parents were out of town...where were they this last time? Are you serious about her myspace page? I hope the judge will make an example out of her!! In my opinion this case has taken way too long!! She killed a man...drinking and caught twice since then...who knows how many times she has been out driving and drinking that she did not get caught??!! Sentence her and give the victims family some flippin closure!! Just my opinion.

I hope that she pleaded guilty because she realized that she was in the wrong, and not just to get a lower sentence. If she really does feel remorse, then I can forgive her. I am glad, if that is the case, that she has realized the errors of her ways. Hopefully she will not return to such activity.

very good point kid. NO one ever looks at alcohol as a drug. I always asked: if I consume so much alcohol, and I completely black out and don't remember ANYTHING the next day: how is this legal? How many people are killed every year by drunk drivers? How many fights occur because of people being drunk? Now alcohol makes you violent, black out and do stuff you would NEVER normally do: and this is legal huh?

rite llund. we read story after story about what this MAN MADE POISON does to our society while we discuss on other blogs about the medical value of marijuana, distribution of marijuana, possession of marijuana, manufacturing of marijuana, and NEVER the carnage of marijuana...cuz it just doesnt exist. if this were drug A and drug B my guess is drug B would be chosen by the majority in a blind taste test:)

My family & my boyfriend & my friends are my life, I love them all to death. People think that they have a clue about my life, when they don’t know anything. I really hate when people judge me. I’m not into the whole party scene. I don’t open up anymore to anyone, only if I truly think you are worth it. If you have hurt me, chances are I will never forgive you and that's your fault. I think it is exceedingly wrong to hook up with your friends boyfriend.

I find it interesting that her friends comments on her myspace thought it was "lame" she could not got to Prom or whatever dance because she was on house arrest. Seems her little friends don't get it either. How very sad.

It is true that Walworth County has some of the most strict penalities anywhere in the state. BUT I have seen where if you have a connected family and money you can get your cases thrown out. HHmm. MAkes one wonder doesn't it?

I'd be more inclined to believe her lawyer told her "you'd better plead out", a trial by jury could be worse. She'll get off with a light sentence by pleading guilty.

She needs to stay behind bars... she's already shown she has NO regard for the law.

This little missy doesn't care about anything. She has no respect for the family of her victim, no respect for the law, nothing. Wow. I must say I was surprised to see that she pleaded guilty. From previous stories it looked as if she was going the not guilty route. Granted with our slack drunk driving laws she may not serve alot of time I have to commend her for stepping up and being an adult and admitting her guilt. She is holding herself responsible for her actions and taking the consequences of them. You don't see that much anymore with youth. (well with alot of people but youth tend to play things off as I am a minor and can't do anything to me, etc..)

I know of the Hispanic gentleman she killed in this accident, but when did she kill another?

She wouldn't have plead guilty if a deal hadn't been worked out so actually Evilhousewife is probably pretty close on the sentencing. The worse case scenario is they let her out on January 30th with the time she has served, around 4-1/2 months by the sentencing date?

Well, she's cute and has permissive parents, not to mention she only killed a pair of hispanics ( NOTE: I am not racist, I think the Justice system is...I AM BEING SARCASTIC) So ...
I predict a year in jail on work release and five years probation. Oh, and since it was a first offense, she'll have her occupational license in six months. That'll show her!
If I were the judge, it's be be 20 years in lockdown and ten years no license after that. If she has been alcohol free for thirty years, maybe I;d be inclined to give her another chance, but for now, she's not ready.
