Delavan businesses must defend liquor licenses

The Delavan City Council on Tuesday:

-- Approved an application for an expansion at Stinebrink's Piggly Wiggly, 1414 E. Geneva St.

The store is proposing a 13,200-square-foot expansion. The council held a public hearing on the issue Tuesday night. Most spoke in favor of the expansion.

Construction could start in June and could wrap up by Thanksgiving, Ben Stinebrink, operations manager for the store, previously told the Gazette.

After the expansion, the store will be 46,200 square feet, Stinebrink said.

— Seven businesses, including Lake Lawn Resort, will have to come before the Delavan City Council and offer reasons why they should be allowed to keep their liquor licenses.

Council members Tuesday night unanimously directed city attorney Steve Koch to inform the businesses that the licenses are up for denial and that the businesses have the right to a hearing to challenge that.

The letters also must inform the businesses why the licenses are up for denial.

All seven businesses owe money to the city, said Jennifer Wiese, treasurer.

According to a memo from Wiese to the council:

-- Buena Vista, 239 E. Walworth Ave., owes $77 in personal property tax.

-- La Guanajuata, 233 E. Walworth Ave., owes $155 in personal property tax.

-- Delavan House Hotel, 215 E. Walworth Ave., owes $3,000 in personal property tax and $33,500 in property tax.

-- Delavan Resort Management, owners of Lake Lawn Resort, 2400 E. Geneva St., owes $761,300 in property taxes and more than $43,100 in other penalties and payments.

-- Los Agaues Restaurant, 401 E. Walworth Ave., owes $240 in personal property tax.

-- Comfort Suites, 313 Bauer Parkway, owes $3,200 in outstanding water and sewer bills and $97,000 in delinquent property taxes.

-- The former owner of the Latimer House, 523 E. Walworth Ave., owes a $64 water and sewer bill.

The council's vote was not a denial of anyone's liquor license. The businesses may continue to serve drinks under their current licenses, Koch said.

Sending the letter is a matter of following city ordinance and being fair to all the businesses and all property taxpayers in the city, council member John Finley said.

"All we're saying is all the little businesses in town have to live by these rules," Finley said. "We're merely trying to make (Lake Lawn) do what they do in every small business in Delavan. We're not persecuting Lake Lawn or any other business on this list."

The meetings will have to be noticed like a regular city council meeting.

The unanimous vote was the third in the council's attempt to agree on how to move forward with Lake Lawn and the other businesses.

Lake Lawn General Manager Pete Zellmer declined comment to the Gazette.
