Afton man charged in sex assault at tavern
JANESVILLE An Afton man is in custody on charges that he raped a Janesville woman behind a tavern on Janesville's south side in July.
James C. Tracy, 28, of 3631 W. Bass Creek Road, Beloit, is charged with second-degree sexual assault. A 38-year-old Janesville woman said he pushed her to the ground, tore off her skirt and underwear and forced sexual intercourse, according to court documents.
Tracy has been in the Rock County Jail since July 26 on suspicion of probation violation.
As of Tuesday afternoon, his initial court appearance on the sexual assault charge had not been scheduled.
According to court documents, Tracy and the woman on July 16 were at Hammy's Roadside Bar, 2131 Center Ave., Janesville. The woman had participated in the bar-sponsored motorcycle ride during the day.
Throughout the night, the man asked her to take off her shirt. She said she spoke with him once, according to court documents.
Tracy told police the woman had been following him around all day and had been rubbing her body on his. He said he went behind the bar to urinate and she followed him.
The woman told police that just after 2 a.m. July 17, she was in the parking lot talking with friends when Tracy asked her to follow him behind the bar.
According to the bar's security video, Tracy at 2:08 a.m. took the woman by the wrist and led her behind the bar. She pulled away but then followed him, according to the complaint.
The woman told police the assault lasted for about four minutes. She said she struggled and yelled at Tracy to stop.
She screamed for help after the assault until another bar patron heard her and at 2:30 a.m. alerted two of her friends. Three people helped her to the parking lot at 2:48 a.m., according to the complaint.
Tracy in a July 25 phone call told police he was in Richland Center and would not come to Janesville to talk to police because he "did not want to go to jail," according to court documents.
He said the woman tried to have sex with him but he was unable to.
On July 26, Janesville police were searching for Tracy and took him into custody when they found him mowing grass on Janesville's south side. He was taken into custody on suspicion of probation violation.
