State Supreme Court hearing Walworth County case
The Wisconsin Supreme Court will hear oral arguments Tuesday morning in a parental-rights case that originated in Walworth County.
The case examines state law and existing case law governing the termination of parental rights and whether a parent must personally withdraw a prior demand for a jury trial.
A woman argued she was denied a fair jury trial because Judge Robert Kennedy did not personally inquire if she understood she was giving up her right to have a jury answer a question related to her child being placed out of the home for six months.
The woman argued that once invoked, a parent’s right to a jury can be withdrawn only if the record shows that it was made personally.
A decision by the Supreme Court could help clarify how the law applies to pleadings in terminations in parental rights cases and to the facts of this case.
