Parents of slain student drop lawsuit

MADISON, Wis. (AP) — The parents of a slain University of Wisconsin-Madison student have dropped their lawsuit against Dane County and a former sheriff’s dispatcher.

An attorney for Kevin and Jean Zimmermann has filed a stipulation in federal court in Madison which says there’s an agreement to dismiss the lawsuit.

Brittany Zimmermann was found murdered in her Madison apartment April 2. Her parents alleged the dispatcher hung up on their daughter when she placed a 911 call the day she died, then failed to call her back.

John Moore, the attorney representing Dane County, says the court filing reserves the Zimmermanns’ right to bring legal action in state court if they so choose.

Did it possibly occur to the Dane County dispatcher that the phone may have been disconnected by the perp? Kathleen Falk should resign from this incident. The dispatcher hasn't even been disciplined in the incident. Kathleen Falk held a news conference and didn't even start out by sending her condolences to the family of the student. She was more worried about covering her behind. And saying that the murder would have happened anyway. WOW WOW WOW what a thing to say.

I do not see any wrong with what most wrote on here. Including rlms.

It is true this lady dispatcher was negligent. Police, Fire, Emt, Dispatchers have to be held to a higher standard because of their jobs. We expect them to do their jobs. She did not. I don't think thats asking a lot.

I do think Rock County 911 did a hexx of a job finding that guy by home depot. He must have had a angel watching over him.

In this case R.C. 911 has been praised over and over again as they should be.

BUT when they screw up such in this case in Madison they need to be held to the wall until things are changed and questions are answered. That dispatcher should have been fired.

Theres no saying that if the dispatcher had followed procedure the girl would have been found. GPS tracking with cell phones is not an exact science. At best the police would have been sent to her building to check the area.

But we will never know. IF the 911 dispatcher had NOT screwed up, we could as least rule out negligence on her part. BUT SHE DID screw up and seems to be very un remorseful as she has insisted she did nothing wrong. I wonder how she sleeps at night. When someone takes a position as police, fire , dispatcher, .. you take that position knowing people's lives depend on you. The very least you can do is follow procedures which this lady did not do. She was lazy and in a hurry. NO excuse. IF you can't handle the pressure and the stress of the job do us all a favor and get the xxxx out.

Sucks to think about, but we are all human, we make mistakes.... yes it COULD have cost someone their life, but chances are if she didn't actually SAY anything into the phone, she was probably not going to make it anyways... There is no telling if THAT is what caused this girl to not get the help she needed... Plus, who's to say that she wasn't trying to hide from the killer and the call back would have just given away her hiding place and he would have killed her then anyways... it's not the 911 dispatcher that murdered her, it was some psycho.... No one REALLY knows completely what happened at that apartment except the killer and the victim.... But that's a whole other story now isn't it....

NO you can't go saying don't blame 911 dispatchers , because then regardless of the situation they will claim its not their fault. This dispatcher in this story was clearly to blame. IT is not about what happened in Rock County.

911 dispatchers did a hell of a job locating the injured man near Home Depot. Don't be too critical of them over an isololated incident. But then again - how many callers phoned 911 last year to ask if there was a tornado in Rock County when it was clearly obvious because the sirens were blaring? Put the critcism where it belongs - on the yahoos who abuse the system.

If you can't count on 911 in an emergency situation, they are worse than useless. All of the money spent, all of the training, all of the planning -- it all comes down to that one moment.

I think quite often the gazette is in to big of a hurry to get the story out there first, they don't proof read.

I think they should have sued for change not so much the money. Not that they would not have got it. That dispatcher should have been fired, not moved to a different job she can screw up. When you take a job like dispatch,police, fire, emt, you better damn well be ready to take the responsibility and she was not. It cost some one their life

I hope that dispatcher was fired. He/she clearly didn't follow procedure by not calling back or sending the police to the home. Had they done that they may have saved her life or caught the person.

It is nice to see a family who is more about policy change than the money. I sure hope the changes to the 911 system stick.

To bad they did. They had a good lawsuit I thought. Maybe the pain of going through the whole thing was to overwhelming for them to go through again. Kathleen Falk should be held accountable for this tragic event and failure in her County. The people of Dane County should be all over her and demanding that she be fired. A life could have been saved if they would have just taken small steps.
