Avery seeking new trial in photographer’s slaying

MANITOWOC, Wis. (AP) — A Manitowoc County man sentenced to life in prison for killing a young photographer in 2005 is seeking a new trial.

Steven Avery’s attorneys filed court documents Monday contending he was denied a fair trial in 2007 because Judge Patrick Willis refused to allow evidence that several other people were possible suspects in Teresa Halbach’s murder.

Avery’s 30-page motion identifies other suspects and outlines possible motives for each. Willis has not set a date for a hearing on the motion, the next step in appealing the convictions to the state Court of Appeals.

Avery and his nephew were convicted of killing the freelance photographer at the Avery family salvage yard. Halbach’s remains were found in a fire pit near Avery’s trailer home.

Avery had been granted several delays in filing the motion seeking a new trial.

I would disagree. Having read all of your posts, it is clear all you really want to do is bash Doyle. Must be nice to be able to lay every problem at the same doorstep. Clearly, Doyle must be responsible for the poor economy in Wisconsin, because business is booming in all other states. Couldn't be that your hero Bush had something to do with wrecking the economy for everyone?

And about 25 times that many left on the street due to a governor who would rather figure out new ways to tax his subjects than keep criminals in jail and a justice system that is far more concerned with hurting a defendant's feelings than considering the victim for one second so take your Amnesty International talking points on over to some MSNBC blog site and hold hands with Keith Olbermann.

Unlike you, I've actually surpassed the maturity level of a 5 year old, otherwise I might suggest a turn in karma for you as well. I won't have to suggest such a thing though, after Doyle is done cleaning out the prisons I'm guessing the odds of that will be much more likely, for all of us unfortunately.

okie, you shouldn't speak unless you have some actual knowledge. Let's see, where would that evidence be kept, how about sealed in the police department evidence lockers. That's why it could still be tested after all this time. The "eyewitness" later after looking at the photo of the DNA match of the actual rapist agreed that he was the man who raped her. She, the victim and only eyewitness, testified to the legislator that the methods of showing photos to victims should be changed to prevent mistaken identifications like hers. As for the jury, when the jury doesn't get the right information they make a decision based on incorrect facts. But thanks for the complement about people like me preventing the death penalty. Not only does it cost more than lifetime imprisonment, but after you have killed the person wrongly convicted it is impossible to correct. At at last count, over 260 people have been determined wrongly convicted. But perhaps, karma will work for okie and you will be wrongly accused of a crime in the near future.

From the news account's,Brendan Dassey participated in the rape & torture of Ms.Halbach.
It is my opinion that Brendan Dassey could have possibly stopped this senseless act.He didn't.Since he didn't he too is where he belong's.

Okiefed, your confidence in his first conviction, simply serves to emphasis your ignorance. Did you forget the part where DNA evidence was discovered of another person committing the rape?? Yes, that DNA lies all the time, it must be telling a lie if Avery is guilty. At the time of his trial they didn't have DNA, or he would never have been convicted in the first place.

I figure he has nothing better to do, than try to stir things up. I doubt it will come to fruition... I agree with BuckyFan08, he's where he need to be.

However, Janesvillean, I think some people are simply born "bad". Be it environment, parenting or lack thereof, mental illness, or whatever. There are just some people that are absolutely not going to be able to rehabilitate.

Charles Manson comes to mind.

Avery is a textbook example of how the prison system makes people worse. The second saddest thing about this, after Halbach of course, is that he took the nephew into prison with him.
