Two motions filed in Janesville homicide case
JANESVILLE -- The man accused of fatally shooting his ex-girlfriend in the city's Fourth Ward neighborhood wants his interview with police thrown out at trial.
The attorneys for Kyle E. Hicke, 37, of 108 Forest Lake Drive, Milton, filed a motion to suppress his statements. They also filed a motion for a change of venue to select a jury from outside Rock County.
Hicke is charged with first-degree intentional homicide, first-degree reckless endangerment, possession of a firearm by a felon and attempting to flee or elude an officer.
He was arrested after the April 22 murder of Erica M. Ostenson, 25, of 412 1/2 S. Academy St., Janesville.

woodsman, even if we know he did it in a prima facie sense, we don't know without a trial or a guilty plea that he is guilty of the crime as described in the law (e.g. first degree, second degree, manslaughter, justifiable homicide, etc.). There is value in the justice process that keeps the system fair and honest. It is only by ensuring that even the hard cases are done well that we protect the rights of the truly innocent.

Just what defense does a person so guilty have? He didn't know what he was doing was wrong? Maybe a jailer should do the human thing and put this thing to rest.

It's a routine defense motion to ask to suppress evidence of this nature. I wouldn't worry about it.

I can't see how his picture of him flipping off the police won't be a major part of the trial. It shows he had knowledge of what he had done was wrong and his flippancy over the fact he just shot a mother of a small child.
