Wis. Supreme Court challenger concedes defeat

MADISON, Wis. (AP) — JoAnne Kloppenburg has conceded defeat in the Wisconsin Supreme Court race against incumbent conservative Justice David Prosser.

Kloppenburg announced her decision Tuesday in Madison.

Kloppenburg's decision comes after a statewide recount reaffirmed Prosser's victory over her in the April 5 election.

Prosser originally won the election by 7,316 votes, out of 1.5 million cast. She picked up only 312 votes in the recount.

Prosser's campaign had said there was no basis for a challenge and it was time to move on.

The election was widely seen as a referendum on Gov. Scott Walker's proposal taking away nearly all collective bargaining rights from most state workers. Conservative Walker backers largely backed Prosser while opponents of the collective bargaining bill lined up behind Kloppenburg.

Prosser's next 10-year term begins in August.

As I understand, Recall elections would be delayed because the SIM chips in voting machines would be held for the court challenge by Kloppenburg. There aren't enough SIM chips available. So, was this a political move ?

JCK ::: Sorry if it looked like my conspiracy comment was directed at you. It wasn't. Just a general outburst of frustration. Should have summarized my explanation with the statement that if people do not follow the rules in filling out machine read ballots, votes will end up not being counted. But still think the optical scanning is a far better system than the old punch cards. Still remember vividly the "hanging chad" debacle in Florida.

SarahB1: I'm not the only one who couldn't stand her voice. And how am I making fun of a genetic thing? Being in the public eye one would think she would get some voice trainIng. I'm also not crazy about Paul Ryan' s speaking skills. Don't you cringe when you hear some of these athletes interviewed? With all the money they make can't they get some coaching on presentation skills? I can' t stand to listen to Tammy Baldwin either. Some women are just better speakers than others. I'm trying to think of a good female speaker...Hilliary Clinton is a good speaker. Nancy Pelosi too, if you don't have to look at her. I liked Madlyn Albright too.

Maynard, I never said a word about any supposed "conspiracy." Actually the thought never even occured to me.

My concern is that, for whatever reason, votes were miscounted. That doesn't sit well with me. It shakes my faith in the electoral process when I'm told the announced results were not accurate.

I'm having trouble with the math. She wins once and declares victory immeadiately. She loses 3 times and it takes her 5 days after the third defeat to concede.

To bad dems. We know it was a referendum on the Governor.

JCK: in following the recount news, I saw that there were cases that, for whatever reason, some people wrote in Kloppenburg's name instead of checking the box for her. Optical scanning did not pick this up and so the vote was not counted for her. On the manual recount, these votes were added on. Others were said to be due to machine error or markings that were not able to be picked up by the scanners correctly. These votes were also added during the manual recount. Why does everything have to be a conspiracy???

Well now that Prosser's seat has been bought and paid for all legal like and everything the conservative activists on the SC can take up the CB bill and overule Sumi 4-3 along party lines. So glad the judiciary is free from partisan politics.

As I've noted before, Kloppenburg was an unknown who had no statewide electoral background, and Prosser was a politician who had a notable legislative career before being appointed a Justice, and had the power of incumbency. Despite this imbalance the election was very close.

The fight for labor rights and our democratic process will continue. We didn't get here overnight. Decades of work across generations is not going to get torn up without a contest.

JCK, much of the concern here is not about individual votes being "miscounted" (and anyway, the 300 vote change is a net change and not indicative of how many votes were not properly processed), but about oversight of the process. Remember, even the Republican-dominated County Board in Waukesha saw a need to audit Kathy Nicklaus. Now that this election is settled, hopefully the GAB will continue to look into her record, and her record-keeping.

Kloppenburg is more sensible then I gave her credit for. Not giving in to the demands of the union to pursue this in court.

It bothers me that over 300 votes were miscounted. I realize that it wasn't enough to change the outcome and it's a small number relative to the total vote count but something has to be done to correct this situation. Voter ID isn't going to solve the problem of miscounted votes.
