Conviction upheld in murder for hire case
MADISON—A state appeals court has upheld the conviction of a Racine woman convicted of being party to the crime of attempted first-degree intentional homicide when she hired a friend $50,000 and a new Harley-Davidson motorcycle to kill her husband.
The Second District Court of Appeals on Wednesday upheld Diane Zimmerman’s conviction and sentencing to 35 years in prison and $185,000 in fines.
Michael Isferding stabbed Zimmerman’s husband but failed to kill him.
Zimmerman argues on appeal that her attorney was ineffective, her “positive” character wasn’t properly considered when sentencing and the amount of her restitution was too much.
The appeals court rejected all her arguments and upheld both her conviction and sentence.
Zimmerman’s attorney Michael Holzman had not seen the opinion and had no comment.
