Was it right to take Brossard case to trial?

The case against Burlington's David A. Brossard, accused of killing his wife, Dawn, in 1997, was slim and circumstantial. Divers found her body deep in Geneva Lake in 2003, but investigators couldn't determine where she was killed. So was the Walworth County District Attorney's Office wise or foolish to try David for first-degree intentional homicide?

This was wrong. A prosecutor has to ask the following question regarding each case being considered for prosecution: Do I reasonably believe that I can prove every element of the offense beyond a reasonable doubt? The clear answer in this case was 'no' from the start. Instead, the D.A. used the overwhelming authority of the State for the benefit of a grieving family. That's not what our system was designed for, yet it happens over and over. I know of one prosecutor who chose to file sexual assault charges on a person, knowing full well that he would never get a conviction with the evidence that he had. His reasoning was that he'd rather lose the case, than not try it and have to face the wrath of "all the womens' rights groups". Sure enough, the jury acquitted in less than an hour. This is simply an improper use of the authority of the State over an individual.

Not sure what real relevance the last two comments have. The county was obviously eager to prosecute following the discovery of her body, but was unable to build a case linking him definitively to it. It's unfortunate that the case failed, but it was also unlikely that it would ever substantially improve, so rolling the dice was risky but may have made little difference in the long run.

Anyone who lives in that County, I'm sure understands. I met my wife there, had two boys there, then.. at some point realized just how corrupt, and unorganized that county Officials were, I got my family outta there. This DA's office, and Judges have let Pedophiles & rapist go free, so for them to try and convict someone, with almost no evidence. Nothing New.

I don't think they had a case. They wasted tax payer money, when they should have taken more time to look at all leads. It was just to easy to blame the soon to be ex..
